1.0 PURCHASE CONTRACT

1.1 This website is operated by P A Arbuckle and Sons (“we”, “us” or “our”). By using the Arbuckle’s Farm Shop website, you are bound by our Terms and Conditions. All purchases made on this website are governed by these Terms and Conditions at any time although the Terms and Conditions governing any given use or purchase will be those in effect at the date of your order or specific use. If you use or order goods after we have published any changes you will be bound by those changes.

1.2 We only sell goods to end users.

1.3 We will confirm your order has been placed using the Arbuckle’s Farm Shop website. This will happen by us sending an e-mail from shop@arbuckles.co.uk to the e-mail address you have provided to us.

1.4 Please note that receipt of order confirmation does not constitute our acceptance of your order. Acceptance of your order and completion of the contract will take place when we hand over the goods to you at the point of order collection.

2.0 PRICING

2.1  With the exception of goods referred to in paragraph 2.2, goods that are sold and priced by each (i.e. a fixed price per item), the price of such goods will be as quoted on the website at the time you confirm your order (usually by clicking the “checkout” button) subject only to any inadvertent technical error for which we will not be liable.

2.2 Where items are ordered and sold individually by weight (such as certain fresh fruit and vegetables), the price of these items (expressed per kilogram or other appropriate unit of measurement) will be the price on the date that they are weighed. Where an indicative price/kg guide is provided on the website, this is purely to assist you in placing your order and the price you will be charged is the price prevailing on the date of weighing for the actual weight you receive. In the event that there is a discrepancy between the price/kg on our website at time your order is made and the price/kg at the time the item is weighed, the price you will be charged will be the price at the time the item is weighed.

2.3 Items offered for sale (ie as displayed on the website) are offered subject to availability. We reserve the right to withdraw items from sale. Where a substitute item is offered in place of an item ordered, the price charged for that substitute item (if accepted) will be the price applicable at the time the item is substituted. Please note that as promotions and discounts may be offered for a limited period of time, subsequent amendments to your order, or orders placed at a later date, may mean that certain promotions or offers are no longer being offered.

2.4 The prices stated on the website will be inclusive of any VAT payable.

3.0 PAYMENT and REFUNDS

3.1 Payment may be made by debit or credit card are processed by WorldPay.

3.2 Any refunds arising from an order paid for will be refunded to the original method of payment, or should you choose (and hold a Arbuckle’s Farm Shop Loyalty Card), these may be refunded as Loyalty Points to your existing points balance.

3.3  The debit, credit and charge cards accepted by us are those listed on the Arbuckle’s Farm Shop website on the date on which your order is placed.

3.4 We reserve the right to cancel your order if we are refused authority for payment or reasonably believe that payment will be refused at any stage.

3.5 You agree to compensate us in full against all reasonable costs expenses and outgoings incurred by us in obtaining payments from you in the event a failed payment occurs.

4.0 CANCELLING AND AMENDING ORDERS

4.1 Any orders placed through the Arbuckle’s Farm Shop website Click and Collect or Pre Order Service may be cancelled by the customer and a full refund given to the original method of payment, provided that this is done before the cut-off time stated on the order confirmation email or if none stated, within 24 hours prior to the chosen order collection date and time. Any orders that have not been cancelled by the stated cut-off time are binding and will not be refunded.

4.2 It is not currently possible to amend confirmed orders. Additional orders can be placed for collection at the same day/time as orders already placed, subject to availability of products and collection slots.

5.0 PACKAGING CHARGES

We do not charge for any packaging and picking incurred by our staff.

6.0 ORDER COLLECTION

6.1 Available collection days and times will be as specified on the checkout page on the website. We reserve the right to restrict or remove available collection days and times at our discretion.

6.2 Products are subject to availability. We may limit the quantities of goods (for example goods on special offer) supplied to a customer if we feel that the quantity ordered jeopardises availability for other customers. In the event of non-availability of any goods you order, we may offer a reasonable substitute. This may affect the price you pay. You may reject any substitute item and we will refund the amount you have been charged for that substitute. It is our policy to identify any substitute items to you before or at the time of collection and give you the opportunity to accept or reject the item at that time.

6.3 We will always try to supply you with the quantity that you have ordered. If you are not satisfied with the quantity you have received we will arrange with you for non-perishable goods to be returned to us (please note that the goods must not be used and must be in good condition). In the event that the goods supplied in your order to you are incomplete or include incorrect goods, you must notify us promptly. You will not be charged for any incorrect goods or goods which you have not received. In such an event, our liability will be limited to the price of the goods not supplied or incorrectly supplied.

6.4 We take every possible care to ensure that orders can be collected within a reasonable time of your arrival on your confirmed collection day and time slot at the Arbuckle’s Farm ShopClick and Collect order point. It is your responsibility to ensure that you (or person nominated by you) is available to collect your order within the specified day and time slot. We may ask that an appropriate person signs for the goods on receipt.

6.5 If no one collects the ordered items within the confirmed day and time slot the goods will be retained by us. We will notify you of the un-collected order using the contact details provided when placing the order and will attempt to make arrangements for alternative collection of the order.

6.6 Please note that adverse weather conditions or other events outside of our reasonable control including a Goverment lockdown may result in delayed or cancelled order collection. Should this be the case, we will endeavour to contact you as soon as we are able to, in order to reschedule your collection time and date. In any event, our liability to you will be limited to the price of goods not collected.

6.7 Arbuckle’s Farm Shop will ordinarily only hand over orders to the person placing the order or their nominated representative, on suitable proof of order confirmation. Arbuckle’s Farm Shop reserves the right to refuse to hand over an order without acceptable proof of order confirmation.

6.8 Arbuckle’s Farm Shop expressly disclaims all liability which may arise by virtue of the collected order being left unattended for a period of time. This includes (but is not limited to) theft, tampering, contamination and the result of any change in temperature in respect of items which need to be kept chilled or frozen.

7.0 SPECIAL OFFERS PROMOTIONS AND COMPETITIONS

7.1 We may change the terms of special offers, or withdraw them altogether, at any time and without prior notice. We will honour at the offer price, any order placed by you before an offer ends, or is amended or withdrawn.

7.2 We reserve the right to offer, at our complete discretion, different customers different special offers or promotions.

8.0 DEFECTIVE GOODS

8.1 We advise that you inspect the goods promptly at the time of collection and notify us of any defects promptly. If you discover a product is faulty, please contact our team on shop@arbuckles.co.uk. On receipt of the goods, we will promptly and fully refund the price of any goods that do not meet with your reasonable satisfaction and offer replacement goods to the same value.

8.2 As a consumer, you have certain legal rights regarding the return of faulty or misdescribed goods. Our refund procedure described above does not affect your legal rights in relation to such goods. Our returns policy is in accordance with statutory rights under the Consumer Contracts Regulations.

Arbuckle’s Farm Shop understands and respects the importance of your privacy and we are committed to safeguarding your personal information. We have set out in the link below what information we may collect about you, how we collect it and how we use it. We pledge to handle your data fairly and legally at all times, and to keep your data secure. We do not share your personal data with any third parties for marketing purposes. We have also detailed your rights with respect to the data we hold about you.

11.0 GENERAL

11.1 If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.

11.2 All copyright, trademarks and all other intellectual property rights in all material or content supplied as part of this website shall remain at all times vested in us or our licensors. You are permitted to use the material data and content only for your personal use in placing orders through the Arbuckle’s Farm Shop website and you may not otherwise copy, reproduce, transmit, publish, display, distribute, commercially exploit, use or create derivative works of any material data and content on the Arbuckle’s Farm Shop website without prior written permission.

11.3 These Terms and Conditions will be governed by English law and the parties submit to the exclusive jurisdiction of the English courts in relation to any dispute which may arise between them.
